If you choose to visit the Service, your visit and any use of the Service are subject to our Terms of Service, including limitations on damages, jurisdiction of disputes and application of the law of the State of Florida.
1. PERSONAL INFORMATION THAT YOU GIVE US.
Depending on how you engage with our Service, we may collect the following categories of personal information from you. We may also collect other personal information that is not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Physical measurements. When you register as a member of the Service, you will need to provide us with your weight, height, age, and related physical measurements, to enable your trainer to design your fitness and nutrition plan. You may also log or self-report additional physical measurements, such as weight progress, BMI, resting heart rate, blood pressure, sleep, and movement. Additional physical measurements may also be collected via wearable devices and third-party apps as described below in the section titled, “PERSONAL INFORMATION COLLECTED FROM CONNECTED DEVICES AND APPS AND OTHER THIRD PARTIES.”

Health information. Depending on how you engage with the Service, you may also self-report physical or mental health conditions, diagnosis, or status, such as to your trainer. Your health information will be associated with your account profile. Additional health information may also be collected via wearable devices and third-party apps as described below in the section titled, “PERSONAL INFORMATION COLLECTED FROM CONNECTED DEVICES AND APPS AND OTHER THIRD PARTIES.” Please review our Consumer Health Data Privacy Policy for more information about how we process consumer health information.

Diet and exercise logs. We maintain your workout and exercise history, and any diet logs that you self-report.

Communications. We collect personal information associated with your requests or inquiries, including for support, assistance, or order information, and any feedback you provide when you communicate with us.

Audio and visual information. We and our service providers record your calls, videos, and chats with our trainers and support team for quality control or training purposes, to enforce our rights, and for marketing.

Professional information. If you register to be a trainer through the Service, you will need to provide us with information regarding your qualifications in designing fitness and nutrition plans.
Unless we specifically request it, we ask that you not provide us with any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Service, or otherwise to us.
Please keep in mind that certain features on our Service give you an opportunity to interact with us and others. These may include group challenges or courses, forums, message boards, chats, creating community profiles, and rating, tagging and commenting on articles. When you use these features, please be aware that any information you submit, including your name, location and email address, may be publicly available to others. We are not responsible for any information you choose to submit to other users and the public through these interactive features.
Also, whenever you voluntarily disclose personal information on publicly viewable web pages, that information can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information.
2. PERSONAL INFORMATION AUTOMATICALLY COLLECTED FROM YOUR INTERACTIONS WITH THE SERVICE.
When you use our Service, we, our service providers, and our advertising partners may automatically collect the following categories of information:

We use these replays for research and development purposes, such as to help us troubleshoot problems with the Site or App, understand how users interact with and use the Site or App, and identify areas for improvement.

SDKs are third-party computer codes used in connection with our App for a variety of purposes, including to provide us with analytics regarding the use of our App, to add features or functionality to our App (such as allowing you connect your third-party accounts to your Hailey Happens Fitness account), or, in the future, to facilitate online advertising. SDKs may enable third parties to collect information directly via our App.

Chat technologies. We may provide chat features on the Service that you can use to communicate with us or, in some cases, a digital “chatbot” that will help respond to your inquiries. Our chat vendors and other third parties may access and use the personal information you provide through the chat feature as well as the online activity information and device information described above, and monitor and record your chats, for the purposes described in this Privacy Policy or as otherwise disclosed at the time of collection.
Third Party Tracking and Social Media Plugins. We may display third-party content on the Service, including third-party advertising. Third-party content operators may use cookies, web beacons, or other tracking technologies that enable them to recognize individuals who have previously visited our Service and to obtain data in connection with your viewing of the third-party content on the Service. Additionally, we may implement third party social media plugins, such as “like” or “share” buttons, to enable you to easily share information with others. If you are logged into the third-party social media platform, these plugins may function as web beacons and allow the third party to collect information about your visit to particular pages on our Service even when you do not interact with the button. Additionally, the Site and App may use Google Analytics or similar analytics providers to help us analyze how the Site and App are being accessed and used. 3. PERSONAL INFORMATION COLLECTED FROM CONNECTED DEVICES AND APPS AND OTHER THIRD PARTIES.
In addition to personal information that we collect from you directly or automatically through your use of the Service, we may collect personal information from the following sources:
Connected Devices and Apps. The Service may allow you to connect your page or profile from a third-party platform, such as Facebook, YouTube, MyFitnessPal, Fitbit, Withings, or a device, such as a Garmin watch, to your Hailey Happens Fitness account. We collect information in accordance with the consent you give when you authorize the connection to your Hailey Happens Fitness account. If you connect your third-party account to your Hailey Happens Fitness account, we may collect certain information stored in your third-party account in accordance with the consent you give when you authorize the connection to your Haily Happens Fitness account, such as profile image, display name, username/page ID or profile ID, access tokens, workout history (activities, GPS, calories burned), steps, health measurement activity (body temperature, respiration, pulse OX, HRV, heart rate, ECG, VO2 max), body fat percentage, height, weight, menstrual logs, stress, sleep, body battery, and other information pertaining to your use of such third-party platforms (e.g., content viewed and data logged).
Other Third Parties. We may receive personal information about you and your activity from additional third parties, including our service providers, advertising partners, data analytics partners, operating systems and platforms, and other business partners that we work with in order to provide you with Hailey Happens Fitness Services, as well as event sponsors, publicly available sources, social media platforms, and data licensors/providers. We may merge or combine such personal information with personal information we collect from directly, automatically, or through your connected accounts to, for example, provide additional insights and tailored programs.
Referrals. Users of our Service may have the opportunity to refer to us colleagues, friends, or other contacts and share their contact information and other personal information with us. Please do not provide us with someone's personal information unless you have their permission to do so.
4. HOW WE USE YOUR PERSONAL INFORMATION.
We may use your personal information for the purposes below or as otherwise described in this Privacy Policy or as disclosed to you at the time of collection.
Providing the Service. We process your personal information to deliver our Service and operate our business, including:

Artificial Intelligence. When operating our business, we may now or in the future use services or applications that are supported by artificial intelligence (AI) or machine learning technologies. For example, we may use such technology to support our marketing or advertising efforts, to develop or improve new features or functionality, or to improve how we address your support requests. Depending on how you interact with us or if you engage with an AI-powered feature, your personal information may be processed to provide relevant outputs or to improve the models we use. Unless you receive a supplemental privacy notice relating to such services, your personal information will continue to be treated in the same ways that are described in this Privacy Policy.
Direct Marketing. We use your personal information to send you Hailey Happens Fitness-related or other marketing communications as permitted by law. You may opt-out of our marketing and promotional communications as described in the section titled “YOUR PRIVACY CHOICES” below.
Targeted Advertising. We may work with third-party advertising companies and social media companies to help us advertise our business, or to display targeted ads for our Service. These companies may use cookies or other online tracking technologies to collect information about you (including the online activity information and device information described above) over time across our Service and other websites and services or your interaction with our emails, and use that information to provide customized advertisements, content, and information or to monitor and analyze the effectiveness of marketing activities. 5. DISCLOSURE OF YOUR PERSONAL INFORMATION.

Connected Devices and Apps, such as Fitbit, MyFitnessPal, or Withings, when you authorize through the Service to connect your Hailey Happens Fitness account to such third-party platforms. We will share information with those third-party platforms in accordance with your authorization, which may include data logged in your Hailey Happens Fitness account, such as calories, workouts, and body weight.

Authorities and Others for Compliance, Fraud Prevention, and Safety, such as in response to a subpoena or similar investigative demand, a court order, or other request from a law enforcement or government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. Other Users, Trainers, and the Public, depending on how you engage with the Service. For example, you may be able to create a profile, participate in a group session, or submit questions and comments that may be visible to other users. You may also be able to submit content in connection with a promotion or otherwise to the Service (such as comments, reviews, photos, and videos), and such content may be made available to other users and public, or used in Hailey Happens Fitness marketing materials, and we may identify you by displaying information such as your name, username, or social media handle along with the content you submit. We do not control how other users or third parties use any personal information that you make available to other users or the public.
In addition, if you elect to make your profile viewable by trainers, all information that you include in your profile may be viewed by trainers. You should not enter any information in your profile that you wish to remain confidential. We recommend that you contact your trainer through Hailey Happens Fitness approved channels only. If you choose to provide a trainer with your personal contact information, you do so at your own risk.
6. YOUR PRIVACY CHOICES.
Depending on your residency and subject to certain legal limitations and exceptions, you may have certain rights relating to your personal information, such as the rights listed below. Please note, these rights may not apply in your jurisdiction or may otherwise be limited by applicable law. We will not discriminate against you for exercising any of your privacy rights.

Confirm Processing. The right to confirm whether we are processing personal information about you.

Access & Port. The right to obtain access to the personal information we have collected about you and, where required by law, the right to obtain a copy of the personal information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance.

Correct. The right to correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes of the processing of the personal information.

Delete. The right to request the deletion of personal information that we maintain about you, subject to certain exceptions.

Opt-Out of “Sales” or “Targeted Advertising.” If we “sell” your personal information or use it for purposes of “targeted advertising,” each within the meaning of applicable U.S. state privacy laws, you can request to opt-out of such processing activities. In most cases, a “sale” is defined as the disclosure of personal information to a third party for monetary consideration or, in some cases, for other valuable consideration.

If you wish to opt-out of “targeted advertising” as it relates to the use of cookies and other tracking technologies on our Site, you can click the cookie icon on the bottom of our Site. You can also broadcast the Global Privacy Control (GPC) signal when visiting our Site. Note that due to technological limitations, if you visit our Site from a different computer or device, or clear cookies on your browser that store your preferences, you will need to return to the Site to select your preferences and/or rebroadcast the GPC signal.
We reserve the right to verify your identity and confirm you are a resident of a jurisdiction that offers the relevant right(s) before processing your request. In certain circumstances, we may decline a request, particularly where we are unable to verify your identity or locate your information in our systems, where you are not a resident of one of the eligible jurisdictions, or where an applicable exception or exemption applies.
If we decline to take action on your request, where required by law, you may appeal such refusal by following any instructions provided in our communication containing our decision or by contacting emailing us as provided at the beginning of this Privacy Policy within a reasonable time period after we sent you our decision. We will process your appeal in accordance with applicable law.
Review and Update Your Account Information. If you have an online account with us, you have the ability to review and update your personal information online by visiting the account management section on the Site or App. You can also review and update your personal information by contacting us as provided at the beginning of this Privacy Policy. Note that we may keep historical information in our backup files as permitted by law.
Opt-Out of Marketing Emails. You may opt out of our marketing-related emails by following the opt-out or unsubscribe instructions located at the bottom of the email or by contacting us using the contact information listed at the beginning of this Privacy Policy. You may continue to receive service-related and other non-marketing emails.
Control App Push Notifications. Upon download of the App, you were provided the option to opt-in to receiving notifications that may include alerts, sounds, and icon badges. Push notifications can be configured in settings on your mobile device.
Advertising Choices. You can limit the use of your personal information for targeted advertising by blocking third-party cookies in your browser settings, using browser plug-ins/extensions, and using your mobile device settings to limit the use of the advertising ID associated with your mobile device. You can also opt out of targeted ads from companies participating in the following industry opt-out programs by visiting the linked websites: the Network Advertising Initiative (https://thenai.org/how-to-opt-out/), the Digital Advertising Alliance (https://optout.aboutads.info), or the European Interactive Digital Advertising Alliance (http://www.youronlinechoices.eu/). Users of our App may opt out of receiving targeted advertising in mobile apps through participating members of the Digital Advertising Alliance by installing the AppChoices mobile app, available here, and selecting the user’s choices. Many of the opt-out preferences described in this section must be set on each device or browser for which you want them to apply. Please note that some of the advertising companies we work with may not participate in the opt-out mechanisms described above, so even after opting-out, you may still receive targeted advertisements from other companies. If you opt-out of targeted advertisements, you will still see advertisements online but they may be less relevant to you.
7. DATA RETENTION AND DELETION.
We keep your personal information only as long as necessary to provide you with the Hailey Happens Fitness Service and for legitimate and essential business purposes, such as maintaining the performance of the Hailey Happens Fitness Service, making data-driven business decisions about new features and offerings, complying with our legal obligations, and resolving disputes. We keep some of your personal information for as long as you are a user of the Hailey Happens Fitness Service. For example, we keep your workout history, exercise history, logged workout and data, and account information.
If you request, we will delete or anonymize your personal information so that it no longer identifies you, unless, we are legally permitted or required to maintain certain personal information, including situations such as the following:

If there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute, we will retain the necessary personal information until the issue is resolved;

8. HOW WE PROTECT YOUR PERSONAL INFORMATION.
We use commercially reasonable administrative, technical, organizational, and physical measures to safeguard personal information in our possession against loss, theft and unauthorized use, disclosure or modification but we cannot guarantee the security of your personal information. Your password protects your user account, so we encourage you to use a unique and strong password, limit access to your computer and browser, and log out after having used the Hailey Happens Fitness Service.
9. CROSS-BORDER TRANSFERS OF PERSONAL INFORMATION.
Hailey Happens Fitness is based in the United States, and we have service providers in the United States and potentially other countries. Your personal information may be collected, used, and stored in these countries or other locations outside of your home country. Privacy laws in the locations where we handle your personal information may not be as protective as the privacy laws in your home country. By providing your personal information, where applicable law permits, you specifically and expressly consent to such transfer and processing and the collection, use, and disclosure set forth in this Privacy Policy.

10. LINKS TO OTHER WEBSITES.
Our Service may contain links to other websites, mobile apps, and online services. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third parties’ privacy practices or content. These third parties may place their own cookies or other files on your computer, collect data or solicit personal information from you. Other sites and services follow different rules regarding the use or disclosure of the personal information you submit to them. We are not responsible for the content, privacy and security practices, and policies of third-party sites or services to which links or access are provided through the Service. 11. CHILDREN’S PRIVACY.
The Service is not intended for users under the age of 18 and we do not knowingly collect personal information from children under the age of 18.
